Terms & Conditions

These Terms & Conditions govern your use of CollectRight, including its articles, guides, glossary, FAQs, Artwork Research, and other tools and services.

CollectRight is published and operated by Khabraal.

By accessing or using CollectRight, you agree to these Terms and our Privacy Notice. If you do not agree, do not use the service.

1. What CollectRight provides

CollectRight is an informational and research resource for people buying, owning, researching, and living with original art.

The site may provide:

  • educational articles and guides;
  • definitions and FAQs;
  • information about buying, documenting, shipping, framing, insuring, conserving, and caring for artwork;
  • Artwork Research reports;
  • public-source research about artists, sellers, artworks, listings, prices, and transactions;
  • tools intended to help users organize information and make their own purchasing decisions.

CollectRight does not sell artwork through the Artwork Research service and does not act as the buyer’s or seller’s agent in transactions researched through the service.

2. Artwork Research

Artwork Research organizes information available from public sources and information submitted by users.

Research may consider information such as:

  • artist identity and professional history;
  • seller identity and apparent relationship to the artist;
  • artwork listing details;
  • publicly available transaction terms;
  • asking prices and other market context;
  • provenance or authentication information where publicly available;
  • galleries, dealers, marketplaces, auction platforms, institutions, press, artist websites, and other relevant sources.

Artwork Research is designed to help users understand the evidence available before making a decision.

It does not guarantee that an artwork, seller, listing, document, or transaction is legitimate.

3. Evidence and sources

CollectRight distinguishes among different kinds of information where reasonably possible.

For example:

  • statements made by an artist or seller remain first-party claims unless independently supported;
  • asking prices are not treated as documented sales;
  • estimates are not treated as sales;
  • a Certificate of Authenticity does not automatically establish authenticity;
  • an artist’s professional history does not authenticate a particular physical artwork;
  • the absence of a publicly identified concern does not establish authenticity.

Sources are provided so users can review relevant evidence themselves.

Public information may be incomplete, outdated, incorrect, removed, changed, or unavailable.

4. No authentication service

CollectRight is not an artwork authentication service.

Unless expressly stated otherwise as part of a separately identified human service, CollectRight does not physically inspect artworks.

Online research, photographs, listing images, signatures shown in photographs, certificates shown online, and public records cannot by themselves establish that:

  • a physical artwork is authentic;
  • the delivered object is the same object depicted online;
  • a signature is genuine;
  • a certificate is genuine;
  • an artwork has not been altered or restored;
  • provenance is complete;
  • a seller has valid legal title.

Where authentication is material to a transaction, users should consider obtaining appropriate specialist advice or physical examination.

5. No appraisal or valuation

CollectRight is not an appraisal service.

Price information may include:

  • asking prices;
  • historical asking prices;
  • documented sales where available;
  • auction results;
  • auction estimates;
  • publicly observed price ranges;
  • other descriptive market information.

These categories are not interchangeable.

Price comparisons and market context provided by CollectRight are informational and do not constitute an opinion of fair market value, replacement value, insurance value, liquidation value, or any other formal valuation.

6. No investment or financial advice

CollectRight is not an investment adviser, broker, financial adviser, securities service, or speculation service.

Nothing on CollectRight should be interpreted as:

  • an investment recommendation;
  • a prediction of appreciation;
  • a prediction of resale value;
  • a recommendation to purchase artwork for financial return;
  • a representation that an artwork will retain its value;
  • financial, tax, or investment advice.

Art can decrease in value, become difficult to resell, or have little or no secondary market.

CollectRight is designed around collecting and purchase decisions, not investment performance.

7. No legal, tax, insurance, or professional advice

CollectRight may discuss topics involving contracts, invoices, copyright, taxes, insurance, shipping liability, conservation, authentication, estate planning, customs, and other professional subjects.

This information is educational.

It is not a substitute for advice from a qualified attorney, accountant, appraiser, conservator, insurance professional, customs professional, authenticator, or other specialist where appropriate.

8. Commercial independence

Artists and sellers cannot pay CollectRight to receive favorable Artwork Research findings.

CollectRight does not receive a commission, referral fee, or other payment if you purchase an artwork researched through Artwork Research, unless a different commercial relationship is expressly disclosed to you.

CollectRight may be funded, sponsored, or supported in other ways as disclosed on the site. Such relationships do not permit a sponsor, artist, seller, gallery, dealer, or marketplace to purchase a particular research conclusion.

9. User-submitted information

You may submit information such as artwork listing URLs, email addresses, ZIP codes, research requests, messages, and other information requested by the service.

You are responsible for ensuring that information you submit is lawful and that you have the right to provide it.

Do not submit:

  • passwords;
  • financial-account credentials;
  • Social Security numbers;
  • payment-card information;
  • highly sensitive personal information that CollectRight has not requested;
  • confidential documents you do not have permission to provide;
  • unlawful material.

Your use of personal information is also governed by our Privacy Notice.

10. Public URLs and research requests

Submitting a publicly accessible URL authorizes CollectRight to access, process, analyze, and summarize information reasonably necessary to provide the requested research.

You understand that the underlying webpage is controlled by a third party.

CollectRight does not control whether that information is accurate, lawful, current, complete, or subsequently changed or removed.

CollectRight may preserve source references, excerpts, research metadata, or other information reasonably necessary to maintain a research report, subject to applicable law and our Privacy Notice.

11. Automated and AI-assisted research

CollectRight may use automated systems, including AI-assisted tools, to search, organize, classify, compare, summarize, and present information.

Automated systems can make mistakes.

CollectRight attempts to preserve source relationships, distinguish evidence types, and communicate uncertainty, but no automated research process can guarantee complete or error-free results.

Users should review important sources and obtain appropriate professional assistance when a decision depends on facts that cannot be established through public research.

12. Access to Artwork Research

Artwork Research may require:

  • a valid email address;
  • email verification;
  • a valid U.S. ZIP code;
  • acceptance of applicable Terms and privacy notices;
  • other reasonable anti-abuse measures.

Access may initially be limited geographically.

CollectRight may impose reasonable limits on research frequency, automated requests, abusive usage, repeated submissions, and system resources. These measures are intended to maintain service quality and prevent misuse.

13. Research history and access

Where CollectRight provides research history, reports are associated with the applicable verified user identity or access credentials.

You are responsible for maintaining control over access to your email account and authentication links.

Do not attempt to access another person’s private research history.

CollectRight may expire sessions or require reverification for security purposes.

14. Acceptable use

You may not use CollectRight to:

  • interfere with or disrupt the service;
  • circumvent access controls or rate limits;
  • conduct automated scraping or bulk extraction without permission;
  • probe or exploit security vulnerabilities;
  • access another user’s private reports or data;
  • submit unlawful or malicious material;
  • impersonate another person or organization;
  • use the service to harass, defame, threaten, or unlawfully target another person;
  • manipulate Artwork Research through intentionally false submissions;
  • use CollectRight findings in a misleading way that materially misrepresents what the report concluded.

We may restrict or terminate access when reasonably necessary to protect the service, its users, or others.

15. Third-party websites

CollectRight links to third-party websites, including artists, galleries, sellers, marketplaces, auction houses, museums, institutions, publishers, government resources, and other sources.

A link does not constitute endorsement.

CollectRight does not control third-party content, availability, privacy practices, security, prices, inventory, transaction terms, representations, or fulfillment.

Your dealings with third parties are between you and those parties.

16. Intellectual property

CollectRight’s original text, design, branding, software, research presentation, graphics, site structure, and other original materials are owned by or licensed to Khabraal and are protected by applicable intellectual-property laws.

Third-party artworks, photographs, trademarks, quotations, source materials, and other content remain the property of their respective owners.

The appearance of third-party material on CollectRight does not transfer ownership of that material to CollectRight or Khabraal.

17. Limited personal use

CollectRight is provided primarily for personal research and educational use.

You may save or print reasonable portions of your own Artwork Research reports for your personal records.

You may not, without permission:

  • systematically reproduce the CollectRight database;
  • republish substantial portions of the service;
  • resell CollectRight research;
  • create a competing database using systematic extraction from CollectRight;
  • remove source or attribution information in a way that materially misrepresents research findings.

Nothing in these Terms limits rights that cannot lawfully be restricted.

18. Corrections

We want research to accurately reflect the evidence available.

If you believe CollectRight contains a factual error about an artist, seller, artwork, listing, source, or other matter, you may contact us with supporting information.

A correction request does not guarantee that content will be changed.

We may evaluate the source of the disputed information, independent supporting evidence, contradictory records, the nature of the claim, and whether the information remains relevant to the service.

CollectRight may correct, clarify, update, annotate, or remove information when appropriate.

19. Service availability

CollectRight may change, suspend, restrict, or discontinue features.

We do not guarantee uninterrupted access, permanent availability of any feature or third-party source, that every submitted artwork can be researched, that every request will produce sufficient evidence, or that all information available on the public web will be discovered.

A research result may appropriately conclude that available information is limited or insufficient.

20. Disclaimer of warranties

To the extent permitted by law, CollectRight is provided on an “as is” and “as available” basis.

We do not warrant that information will always be complete, accurate, or current; every relevant source will be discovered; Artwork Research will detect every problem; an artwork is authentic; a seller has legal title; a transaction is safe; an artwork will retain or increase in value; or the service will be uninterrupted or error-free.

Nothing in this section excludes warranties or rights that cannot legally be excluded.

21. Limitation of liability

To the extent permitted by applicable law, Khabraal and CollectRight will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from your use of or reliance on CollectRight.

This includes losses relating to artwork purchases or sales, authenticity, attribution, provenance, condition, restoration, shipping or damage, insurance, resale value, investment performance, seller conduct, and third-party websites or services.

You remain responsible for your purchasing decisions and for determining what additional diligence or professional advice is appropriate.

Nothing in these Terms limits liability that cannot legally be limited.

22. Privacy

Our collection and use of personal information is described in the CollectRight Privacy Notice.

The Privacy Notice is incorporated into your use of the service where applicable.

23. Changes to these Terms

We may update these Terms as CollectRight evolves.

When material changes are made, we will update the date at the top of this page and provide additional notice where appropriate.

Your continued use after updated Terms become effective constitutes acceptance where permitted by law.

Where affirmative acceptance is legally or operationally required, we may ask you to accept the updated Terms before continuing to use certain features.

24. Governing law

These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles, except where applicable law requires otherwise.

Any venue or dispute-resolution provision should be interpreted subject to rights that cannot legally be waived.
